Uber and City of Calgary head to court on injunction application

The court process begins this morning for Uber drivers named on an application for an injunction that was filed by the City of Calgary on Monday.

The appearance will be in justice chambers Friday morning but those matters are only set for up to 20 minutes. It is expected the matter will be sent to Nov. 20 — a date that has already been reserved to hear the application.

The city is trying to stop Uber from breaking bylaws by driving vehicles without proper insurance. 

Uber has been telling drivers that their personal insurance provides primary coverage, while each ride is also covered by the company's contingent coverage up to $5 million for personal injury and property damage.

But the city says a driver's personal insurance is ified when riders in private, unlicensed vehicles are charged.

The injunction being sought by the city says anyone who fails to comply to the terms of the order "may be arrested by officers of the Calgary Police Service and brought before this court to show why they should not be cited in contempt."

Uber lawyer hired 

Don Carruthers is one of the drivers and says he feels confident that Uber is supporting him.

The company, according to Carruthers, has hired a lawyer who will attend today's appearance on behalf of the drivers.

Carruthers says he had a lengthy phone call with the lawyer who he called "competent and experienced."

In April, the City of Edmonton also attempted to stop Uber drivers by seeking an injunction, but it was struck down. 

The city is looking to amend its livery transportation bylaw to allow the app-based ride-sharing company to operate.
